WHY WE COLLECT PERSONAL INFORMATION
We collect your personal information because:
It helps FlexCharging deliver the FlexCharging Account Services;
It helps FlexCharging deliver a superior level of customer service;
It enables FlexCharging to give you convenient access to our services;
It helps FlexCharging keep you posted on the latest product announcements, software updates, special offers, and events that you might like to hear about. If you do not want FlexCharging to keep you up to date with FlexCharging news, software updates and the latest information on products and services please send an email request to privacy@FlexCharging.com.
WHAT INFORMATION WE COLLECT AND WHEN WE COLLECT IT
If you wish to utilize FlexCharging Account Services, FlexCharging needs your information for purposes of processing and transmitting information to drive the correct data and content between servers and apps for your experience.
Also, there are a number of situations in which your personal information may help us give you better service. For example:
We collect three main types of information related to you or your use of our products and services: (1) information from or about you or your devices; (2) information from or about your vehicle; and (3) information from or about your energy products. Depending on the products and services you request, own, or use, not all of these types of information may be applicable to you;
From our about your devices:
We may collect information from or about you (such as your name, address, phone number, e-mail, payment information, etc.) or your devices;
From or about your vehicle:
We may collect information about your vehicle, including your vehicle identification number. We may also collect information about your credentials for your account with your auto maker which allows us to collect information about geolocation of your car, how much your car is driven per day, and how much electricity is used. This information is retrieved by contacting your auto maker’s web service.
Charging station information:
We may collect information regarding the charge rate and charging stations used by you (including outlets) in order to, e.g., analyze which charging stations are being utilized, how long and efficient battery charges are, and where additional charging stations are needed.
When you visit the FlexCharging mobile application, we may ask you to opt in to allow us to use GPS technology (or other similar technology) to determine your current location for purposes of reporting on user activity and engagement. If you do not want us to use your location for the purposes set forth above, you should not opt in or turn off the location services for the FlexCharging mobile application located in your account settings or in your mobile phone settings and/or within the mobile application;
We may use personal information to provide products and/or services that you have requested as well as for auditing, research, and analysis to improve FlexCharging’s products.
HOW WE MAY SHARE INFORMATION WE COLLECT
FlexCharging takes your privacy very seriously. FlexCharging does not sell or rent your contact information to other marketers or any other third party. If you wish to utilize the FlexCharging Account Services, FlexCharging discloses your information to third party service providers and institutions for purposes of processing and transmitting information to drive the correct data and content between servers and apps for your experience.
We may share information we collect with our service providers and business partners, with other third parties you authorize, with other third parties when required by law, and in other circumstances. Examples of how we share information with these parties and under these circumstances are provided below.

We do not share information that personally identifies you with unaffiliated third parties for their marketing purposes unless you opt in to that sharing.
YOUR COMMUNICATION CHOICES
Receiving electronic communications from us or our affiliates: If you no longer want to receive marketing-related e-mails from us or our affiliates, you may opt out of receiving them by following the opt-out instructions in any e-mail received from us or by contacting us at the address below. Please note that we may still send you important administrative and safety messages even if you opt out of receiving marketing e-mails.
INTEGRITY OF YOUR PERSONAL INFORMATION
FlexCharging allows you to keep your personal information accurate, complete, and up to date. If you identify any personal information that is out-of-date, incorrect or incomplete, let us know and we will make the corrections promptly and use every reasonable effort to communicate these changes to other parties who may have inadvertently received incorrect or out-of-date personal information from us. In the event that you delete your information, such deletion may make it impossible for FlexCharging to continue offering you some or all of the FlexCharging Account Services.
FlexCharging retains personal information only as long as we are required to for our business relationship or as required by applicable laws. FlexCharging has appropriate procedures in place with respect to the destruction, deletion and disposition of personal information when it is no longer required by FlexCharging, subject to applicable law.
We do not knowingly collect personal information from children under the age of 13. If a child under the age of 13 submits personal information to FlexCharging and we learn that that personal information is the information of a child under the age of 13, we will attempt to delete the information as soon as possible.
EU-US PRIVACY SHIELD FRAMEWORK
The following provisions govern information collected in reliance on the EU-U.S. Privacy Shield Framework Principles for transfers of personal data from the EU to the United States. FlexCharging adheres to the Privacy Shield Principles (“Principles”) and is committed to subject to the Principles all personal data received from the EU in reliance on the Privacy Shield. Individuals from whom FlexCharging collects personal information under the Privacy Shield have the right to access their personal data by contacting FlexCharging at privacy@FlexCharging.com. As a result of certification to the Privacy Shield, FlexCharging is subject to the investigatory and enforcement powers of the FTC, the Department of Transportation, or any other U.S. authorized statutory body.

When FlexCharging collects personal information from individuals, it will inform the individual of the purpose for which it collects and uses the personal information and the types of non-agent third parties to which FlexCharging discloses or may disclose that information and the purpose for which it does so. FlexCharging shall provide the individual with the choice and means for limiting the use and disclosure of their personal information. Notice will be provided in clear and conspicuous language when individuals are first asked to provide personal information to FlexCharging, or as soon as practicable thereafter, and in any event before FlexCharging uses or discloses personal information for a purpose other than for which it was originally collected.
In instances in which FlexCharging is not the controller or collector of the personal information, but only a processor, FlexCharging will comply with the instructions of the controller of such information; provide appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, and to the extent appropriate, assist the controller in responding to individuals exercising their rights under the Principles.
In those instances in which FlexCharging collects personal information from individuals, it will offer individuals the opportunity to choose (opt out) whether their personal information is (1) to be disclosed to a third party or (2) to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. If you would like to review, correct, update, or request blocking or deletion of information previously provided by you, you may contact us at the address below. In your request, please make clear what information you would like to have changed, whether you would like to have the information that you have provided to us suppressed from our database, or otherwise let us know what limitations you would like to put on our use of the information that you have provided to us. For your protection, we may only implement requests with respect to the information associated with the particular e-mail address that you use to send us your request, and we may need to verify your identity before implementing your request.
DISCLOSURES TO THIRD PARTIES
FlexCharging will only make disclosures of personal information to third parties if it has first disclosed to the data subject that the data subject is giving FlexCharging permission to make such disclosure. The individual shall have the choice to opt out of a FlexCharging Account Services. FlexCharging shall ensure that any agent third party to whom personal information may be disclosed subscribes to these Principles or are subject to law providing the same level of privacy protection as is required by these Principles and agree in writing to provide an adequate level of privacy protection.
FlexCharging shall take reasonable steps to protect personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction. FlexCharging has put in place appropriate physical, electronic and managerial procedures to safeguard and secure the information from loss, misuse, unauthorized access or disclosure, alteration or destruction. FlexCharging cannot guarantee the security of information on or transmitted via the Internet.
FlexCharging shall only process personal information in a way that is compatible with and relevant for the purpose for which it was collected or authorized by those who provided the information. To the extent necessary for those purposes, FlexCharging shall take reasonable steps to ensure that personal information is accurate, complete, current and reliable for its intended use.
In those instances in which FlexCharging collects personal information directly from individuals, FlexCharging shall allow those individuals access to their personal information and allow the individual to correct, amend or delete inaccurate information, except where the burden or expense of providing access would be disproportionate to the risks to the privacy of the individual in the case in question or where the rights of persons other than the individual would be violated. As noted above, you may not delete all information if you wish to maintain an account with FlexCharging.
RECOURSE, ENFORCEMENT, AND LIABILITY
a) Dispute Resolution
If you filed a complaint with FlexCharging and it has not been properly addressed, JAMS is designated by FlexCharging as the independent dispute resolution body to address complaints regarding FlexCharging’s collection of personal information and provide appropriate recourse. Such body will not charge the complaining party for its services. Follow this link to the complaint submission form for the above referenced independent dispute resolution body.
b) Binding Arbitration
If your claims as to data covered by the EU-U.S. Privacy Shield have not been remedied through dispute resolution directly with FlexCharging or through independent dispute resolution as described above, such “residual claims” may be heard by a “Privacy Shield Panel” composed of one or three arbitrators as agreed upon by the parties. The Privacy Shield Panel may only award individual-specific, non-monetary equitable relief (e.g. access, correction, deletion of the individual’s data in question) necessary to remedy the violation of the Principles only with respect to the individual. Damages, costs, fees and other remedies may not be awarded, and each party bears its own attorney’s fees. This arbitration option is only available for an individual to determine for such “residual claims” whether FlexCharging has violated its obligations under the Principles as to that individual and whether any such violation remains fully or partially unremedied.

To make sure your personal information is secure, we communicate these privacy guidelines to FlexCharging employees and strictly enforce privacy safeguards within the company.

If there is a dispute between you and FlexCharging regarding your personal information or this policy, you agree to use reasonable efforts to resolve such dispute with FlexCharging informally and to consult and negotiate with FlexCharging in good faith to reach a fair and equitable solution.
